DMCA Notice
Plumbing Mission Bend respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using our website (the “Site”) that are properly reported to our designated agent.
Designated Agent
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this Site, please notify our designated copyright agent:
Copyright Agent
Plumbing Mission Bend
[Your Address]
Email: dmca@plumbingmissionbend.com
(If you prefer to use a physical address, replace with your business address. If not, email alone is acceptable for many sites.)
How to File a Notice
To submit a claim of copyright infringement, you must provide our designated agent with a written communication (email or physical letter) that includes substantially the following:
-
Physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
-
Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the Site are covered by a single notification, a representative list of such works.
-
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page).
-
Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address.
-
A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
-
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
What Happens Next
Upon receipt of a valid DMCA notice, we will:
-
Remove or disable access to the allegedly infringing material.
-
Take reasonable steps to notify the user who posted the material.
-
In cases of repeat infringement, we will terminate access to the Site for the infringing user.
Counter-Notification
If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must be a written communication that includes:
-
Your physical or electronic signature.
-
Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled.
-
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
-
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.
If we receive a valid counter-notification, we may restore the removed material unless the original complaining party files a court action against you within 10 business days.
Repeat Infringers
Plumbing Mission Bend reserves the right to terminate, in appropriate circumstances, users who are repeat infringers.
